Eligibility and acceptable use
You must be at least 18 years old to purchase products from Miracelle™.
You agree not to misuse the Site. This includes unlawful activity, fraudulent activity, scraping, reverse engineering, attempting to disrupt the Site, or using the Site in a way that may damage Miracelle™, our customers, or third parties.

Our total liability for any claim relating to the Services will not exceed the amount you paid for the product giving rise to the claim.
Some jurisdictions do not allow certain limitations or exclusions, so parts of this section may not apply to you.
Nothing in these Terms limits liability for fraud, wilful misconduct, gross negligence, personal injury caused by negligence, or any non-waivable consumer rights.

You agree to defend, indemnify, and hold harmless Miracelle™ from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising from or related to:

Governing law, arbitration, and class-action waiver
These Terms are governed by the laws of Singapore, without regard to conflict-of-law rules.
If you are a consumer habitually resident in another jurisdiction, you may also have mandatory consumer protection rights under the laws of your place of residence. Nothing in these Terms affects those non-waivable rights.
U.S. residents: arbitration and jury waiver
If you reside in the United States, any dispute, claim, or controversy arising out of or relating to the Services or these Terms will be resolved by binding arbitration on an individual basis, rather than in court, except that:

Either party may seek injunctive relief in court to protect intellectual property or proprietary rights
You and Miracelle™ waive any right to a jury trial.
The arbitration will be administered by the American Arbitration Association, also known as AAA, under its Consumer Arbitration Rules, as modified by this section. The Federal Arbitration Act governs the interpretation and enforcement of this arbitration provision.
You may choose to conduct the arbitration by video conference or telephone. If an in-person hearing is required, it will take place in your U.S. county of residence, unless we mutually agree otherwise.
AAA filing fees and arbitrator fees will be governed by the applicable AAA rules. If your claim is for US$10,000 or less, Miracelle™ will reimburse your share of filing and administrative fees after the arbitration concludes, unless the arbitrator determines that your claim was frivolous or filed for an improper purpose.
Each party will pay its own legal fees unless the arbitrator awards fees under applicable law.
Class-action waiver
Disputes must be brought only in an individual capacity.
You and Miracelle™ agree not to bring claims as a plaintiff, class member, or representative in any class, collective, consolidated, or representative action.
The arbitrator may not consolidate claims without the consent of all parties.

You must send the opt-out request within 30 days of the date you first accepted these Terms. Opting out of arbitration does not affect the other provisions of these Terms.
Non-U.S. residents
If you do not reside in the United States, disputes may be brought in the courts of Singapore on a non-exclusive basis.
You may also bring proceedings in the courts of your place of residence where required by applicable law.
Export and compliance
You agree to comply with all applicable laws, including export control, customs, and sanctions regulations.
We may refuse, cancel, or restrict orders where required by law or where fulfilment may breach applicable regulations.
Changes to the Services or Terms
We may update the Site, Services, products, policies, and these Terms at any time.
The version posted on the Site is the version that applies.
If we make material changes, we will update the “Last updated” date above.
Severability and entire agreement
If any part of these Terms is found to be unlawful or unenforceable, that part will be limited or removed to the minimum extent necessary. The remaining Terms will continue in full force.
These Terms, together with the policies linked on the Site, form the entire agreement between you and Miracelle™ regarding the Services.
